I copied the version below from this pastebin.com entry. HR 1540 is the "National Defense Authorization Act for Fiscal Year 2012", the "Public Print" version. The sections in question are 1031 and 1032, under "Subtitle D--Detainee Matters".

Whereas, on the 14th of December, 2011, the House of Representatives of these United States voted in favor of indefinite military detention, without charges, of any American, anywhere, anytime, without due process of law, at the discretion of the government alone;

Whereas, the proscription against the use of military force to police the populous has been an essential feature of American civic life and civic liberty since the arrival of our civilization upon this continent;

The Jews In The Attic Test

To the best of my knowledge I am the originator of this test and the name I use to describe it. It first came about in 1999 while I was working with Cease Fear (Cease Fear predates The Pink Pistolsby about a year although the Pink Pistols is far more successful).

We were putting hand-outs in the shops in the Capital Hill area of Seattle for NRA Refuse to Be A Victim and Home Firearm Safety classes. The Capital Hill area is well known LGBT (Lesbian, Gay, Bi, and Trans-sexual) community in the Seattle area. Our goal was to teach people of the LGBT community how to defend themselves against people who would attack them (gay-bashings).

Several of the others and I in Cease Fear were certified NRA firearms instructors and were willing to donate our time to help make their lives safer. One of the discussions we had amongst ourselves as we walked from shop to shop was how to explain to others how important our right to keep and bear arms was to our freedom.

People tend to understand the importance of freedom of speech and the freedom of the press pretty well and some of the other rights guaranteed by the Bill of Rights. But the Second Amendment was and is viewed as unimportant and perhaps even counterproductive by many in today's society.

I explained to the others in my little band of activists that I looked at all laws that restricted freedom with a view to the impact it would have in a worst case scenario of our government run amok. Will this law make it difficult or impossible to protect innocent life from a government intent on their imprisonment or death?

Although I pretty much made everything up on the spot I told them I called this test my "Jews In The Attic Test". Furthermore I told them that if it fails this test no further discussion is really needed, the law must be opposed in the most vigorous manner possible.

Some laws that fail the test and why:

Government mandated ID cards and the authority to demand them at any time. The oppressed class will be unable to masquerade as a member of the neutral or oppressor classes.

Searches without probable cause. Imagine you are attempting to smuggle your "Jews in the attic" to a safer hiding place. If the police at the roadblock can search all vehicles then you and your precious cargo are headed to the "work camps".

Government monopoly on medical care. This is a bit surprising -- isn't it? If it is illegal for you to pay someone for anonymous health care then how can your "Jews in the attic" receive health care?

Firearm or firearm owner registration. The registration information can be used to confiscate the firearms used to protect innocent life -- as it was under the 1938 Weapons Control Act in Nazi Germany.

Elimination or severe restriction of anonymous financial transactions. The purchase of food and other supplies for your "Jews in the attic" would show up in the records as being excessive compared to what your needs were. Just as power consumption records are used today to catch home marijuana growers.
I continue to use this test to this day and advocate its widespread use by others.

The part about the pistol rifle is close, but once shtf, the pistol will have almost no value, because nearly everyone will be carrying a longarm, and under lethal threat and without ear protection, the pistol aint worth a hoot on men beyond 10 yds, if they are fully exposed and stattionary. With them being bobbing heads around cover, it aint worth a hoot at 5 lousy yds.
The pistol is vital for now, tho, cause you can’t carry a rifle around. You can have one in your vehicle, another in your home and busisness, and move one back and forth, especially the M4, which easily breaks down into 2 concalable “halves” in 5 seconds and reassembles to fire in 10 seconds.
The lack of water will force townies to flee. Some, who live near a river, may be able to stay, if they have a large filter and a way to store water, but the cities will be full of dog packs, and be at extreme risk of massive fires.
If people see your home is occupied, many will have nothing better to do than “hole up” and shoot at you with their rifles, whenever they get the chance. It won’t take hordes of people, it only takes 1-2, and your neighbors are the most likely culprits. Not one person in 1000 is properly prepped, or ever will be, so they will have no choice but to become a looter.

Writing this in response to a friends comment on food stamps and EBT cards. They thought a person should not eat salmon or KFC with their food stamps. Here is my view.

I just remember the old saying, people in glass houses should not throw stones. Not saying I like it, just that it could happen to anyone. There are soooooo many unemployed now that it is not uncommon.

I feel no anger over this issue. it is such a small chunk of the pie that it is a waste of time to bother over. I would be far more concerned that someone would go hungry because of asinine rules and some Napoleonic Dictator administrators of the new, more rigid food policy. When it went to the debit card it cleaned up most of the cheats.

So someone goes hungry because you think someone is getting a little to much food or doesn't quite deserve their food. With the cards, it is now very difficult to cheat. Frankly, I would like a piece of fresh salmon or a half a KFC chicken too if I were on food stamps.

Because someone gets a chicken breast and fries or a really nice piece of salmon which you don't think they should have or deserve, maybe that's the price paid for making sure this baby or that elderly fella and that nursing mom get what they need. I'm good with that.

Rangle, Kennedy and so many others have probably stolen more by a factor of thousands or tens of thousands then someone getting a little extra on their food stamps.

Perspective. Focus on these bastards. Corporate sons-O-bitches, stealing billions and trillions of your hard earned dollars. Pharmaceutical companies. Insurance companies. The Goram Banksters. This is just a short list. You could add hospitals and their overcharging to that list too. These are the people who are robbing you blind. Not some poor person who gets an extra chicken breast or two.

I read this thread and I can see that the anger over what is happening in our country today is gravely misplaced. It is being focused on the lowest level of society when in reality, we should be marching on the gates of Washington and Wall Street with pitch forks and torches.

You could cover all the KFC bought with food stamps with the last vacation Moochelle took. Wake up. Figure it out. Focus on the real criminals. SHIT, the last time Moochelle went to the farmers market in DC, It cost us, the American Tax Payer, 80 THOUSAND DOLLARS and you are all worried about some old lady with a piece of fish. Her last party dress cost more then most folks homes and it was purchased with our money.

Once the money is transfered to the individual, it is theirs to do with as they please. Smart decision or dumb. Why not focus on the POS Asshole Congressmen and senators who are robbing you of not only your cash but your rights as well, not the least to mention the POS in the WH. Focus your ire on those dick heads who have absolutely robbed you blind and do it today with impunity.

Your anger is displaced. The bastards in Congress have every perk imaginable, ON YOUR DIME. They have perks you could not hope to get, up to and including full pension on retirement after one term in office.

Now that shit pisses me off.

They are our servants, not kings and queens. Open your damn eyes and see the truth. Get off the little guys back. Grab your pitchfork and torch and head to Washington.

History has shown that you're like a dog on a chain when times get tough. Pissed off and frustrated. You get the chance to let it out and you attack the first helpless thing you can find. In this case it is the little guy and you're kicking him in the gut while he is down.

We are being played. People, you need to see this and focus on those who truly deserve your ire.

FDA thinks it can engage in search and seizure willy nilly.

They've already been doing this, of course -

but only at natural food facilities.

A few hours ago, the Food and Drug Administration declared it no longer needs credible evidence to seize food that may be contaminated. Ignoring the Fourth Amendment entirely, the FDA claims that based on mere suspicion that a food product has been contaminated or mislabeled, and that serious illness or death will result, it can hold the food for 30 days while it then looks for evidence. It claims this power under the Food Safety Modernization Act, which President Monsanto, I mean, Obama, signed in January.
Credible evidence no longer applies, it seems.

The Fourth Amendment states:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

"Was the government to prescribe to us our medicine and diet, our bodies would be in such keeping as our souls are now."

That's often paraphrased as:

"If people let the government decide what foods they eat and what medicines they take, their bodies will soon be in as sorry a state as are the souls of those who live under tyranny."

This morning, about 6am, I was standing outside, the light of the day peeking out from behind a stand of trees, clouds casting a gray and dreary countenance, a light rain falling. As if the day itself were sad and tearful. I had just finished putting up the second of two American Flags in memory of this day. I wiped a bit of moisture off my cheek. My black Stetson shielded my face from the rain, It was tears that I wiped away.

I was remembering a visit to New York, now, many years past. An exciting ride to the top of the South Tower Observation Deck and a spectacular view of the city of New York and the Statue of Liberty. I'll never forget those memories. More precious now because of what my memories turned to as I set these beautiful Red, White and Blue Stars and Stripes in place.

I remember that day nine years before. I will never forget. I was on my way home from a job site and stopped at a convenience store for a really bad lunch and something to drink when I noticed a group of several women gathered off to the side of the counter. I offhandedly remarked, "what's the meeting all about, girls". One of the women turned to me, her face crestfallen, ashen, looked at me with tears in her eyes and said,"They flew planes into the World Trade Center."

I replied, "they, did not" "real funny" "come on, what gives" She said, "no, it's true." And so it was true. When I got back to my truck, I turned the radio on and caught the news which by this time was now constant. Planes were grounded. The military was on high alert. We had been attacked.

I pulled into my drive. Had to consciously make my feet move. Opened the front door saw my wife's face. It was a mirror of the women I had spoken with in the store. My wife and mother-in-law were watching. It was oppressively sad. I cried with my wife and her mom that day. It was heart wrenching. I could not understand. I did not or could not find reason. What would bring some one to do such a horrible, ungodly act.

Today, I know. Today, I remember. Today, I will not forget.

This sudden “cancellation” occurred within a few hours after I had posted critical stories about Democrat for California governor Jerry Brown receiving donations from Code Pink. The stories outlined how Code Pink has been funding terrorism in Gaza and Iraq, and stalks military funerals in the U.S., telling parents their children “deserved” to die in the war efforts. I was asking Jerry Brown to refund the donations and renounce Code Pink.

I was told by Facebook only that there were “complaints” that I was a “fake identity.” I was told that my account would be reviewed if Iwould provide my passport or driver’s license via email to a Facebook address. City of Chicagowas a victory for gun owners, but only by a one-vote margin. Of the nine justices, four ruled not to allow Mr. McDonald to own and possess a firearm in his house.

Monsanto says it has no interest in the bill and would not benefit from it, but Monsanto's Michael Taylor who gave us rBGH and unregulated genetically modified (GM) organisms, appears to have designed it and is waiting as an appointed Food Czar to the FDA (a position unapproved by Congress) to administer the agency it would create without judicial review if it passes.

Foreclosures Continue To Dramatically Increase In 2010

In a very alarming sign for the U.S. economy, foreclosures have continued to dramatically increase in 2010. But there has been a shift. Back in 2007 and 2008, experts tell us that most foreclosures were due to toxic mortgages. People were being suckered into mortgages that they couldn't afford with "teaser rates" or with payments that would dramatically escalate after a few years, and when those mortgages reset, the people who had agreed to them no longer could make the payments. But now RealtyTrac says that unemployment has become the major reason for foreclosures. Millions of Americans have become chronically unemployed during the economic downturn and many of them are losing their homes as a result. But whatever the cause, one thing is certain - foreclosures have continued to skyrocket at a staggering rate.

Finally!

At long last a major city in the US (Fort Worth has a population in excess of 600,000) is considering doing what desperately needs to be done: killing defined benefit pension plans for public workers.

Instead, the union suggests "an additional 6 percent of payroll to the pension, which would fix the shortfall in a few years". Where would that contribution come from? Taxpayers of course. Will it fix the system? No, it will not fix the shortfall because of insane pension plan assumptions.

The only solution is to kill these plans right here, right now. Unfortunately, such action will not fix the problem of unfunded plans for current vested employees, but it is a major step in preventing further buildup of a fiscally insane proposition.

If unions had any common sense they would embrace, not fight these decisions. The reason of course is the only other solution for cities would be to resolve these difficulties by declaring bankruptcy, putting accrued benefits at risk.

There is, however, no solution available. Period. Simple as that. The government has dug itself into a hole when it comes to mortgages and mortgage-based securities that it cannot find a way out of.

When the last doll is lifted, there will, for the vast majority of the population, be nothing left. At all. That is, except for the tens of trillions in debt. That will remain.

50 Statistics About The U.S. Economy That Are Almost Too Crazy To Believe

Most Americans know that the U.S. economy is in bad shape, but what most Americans don't know is how truly desperate the financial situation of the United States really is. The truth is that what we are experiencing is not simply a "downturn" or a "recession". What we are witnessing is the beginning of the end for the greatest economic machine that the world has ever seen. Our greed and our debt are literally eating our economy alive. Total government, corporate and personal debt has now reached 360 percent of GDP, which is far higher than it ever reached during the Great Depression era. We have nearly totally dismantled our once colossal manufacturing base, we have shipped millions upon millions of middle class jobs overseas, we have lived far beyond our means for decades and we have created the biggest debt bubble in the history of the world. A great day of financial reckoning is fast approaching, and the vast majority of Americans are totally oblivious.

But the truth is that you cannot defy the financial laws of the universe forever. What goes up must come down. The borrower is the servant of the lender. Cutting corners always catches up with you in the end.

Sometimes it takes cold, hard numbers for many of us to fully realize the situation that we are facing.

So, the following are 50 very revealing statistics about the U.S. economy that are almost too crazy to believe....

#50) In 2010 the U.S. government is projected to issue almost as much new debt as the rest of the governments of the world combined.

#49) It is being projected that the U.S. government will have a budget deficit of approximately 1.6 trillion dollars in 2010.

#48) If you went out and spent one dollar every single second, it would take you more than 31,000 yearsto spend a trillion dollars.

#47) In fact, if you spent one million dollars every single day since the birth of Christ, you still would not have spent one trillion dollars by now.

#46) Total U.S. government debt is now up to 90 percent of gross domestic product.

#45) Total credit market debt in the United States, including government, corporate and personal debt, has reached 360 percent of GDP.

#44) U.S. corporate income tax receipts were down 55% (to $138 billion) for the year ending September 30th, 2009.

#43) There are now 8 counties in the state of California that have unemployment rates of over 20 percent.

#42) In the area around Sacramento, California there is one closed business for every six that are still open.

#41) In February, there were 5.5 unemployed Americans for every job opening.

#40) According to a Pew Research Center study, approximately 37% of all Americans between the ages of 18 and 29 have either been unemployed or underemployed at some point during the recession.

#39) More than 40% of those employed in the United States are now working in low-wage service jobs.

#38) According to one new survey, 24% of American workers say that they have postponed their planned retirement age in the past year.

#37) Over 1.4 million Americans filed for personal bankruptcy in 2009, which represented a 32 percent increase over 2008. Not only that, more Americans filed for bankruptcy in March 2010 than during any month since U.S. bankruptcy law was tightened in October 2005.

#36) Mortgage purchase applications in the United States are down nearly 40 percent from a month ago to their lowest level since April of 1997.

#35) RealtyTrac has announced that foreclosure filings in the U.S. established an all time record for the second consecutive year in 2009.

#34) According to RealtyTrac, foreclosure filings were reported on 367,056 properties in March 2010, an increase of nearly 19 percent from February, an increase of nearly 8 percent from March 2009 and the highest monthly total since RealtyTrac began issuing its report in January 2005.

#33) In Pinellas and Pasco counties, which include St. Petersburg, Florida and the suburbs to the north,there are 34,000 open foreclosure cases. Ten years ago, there were only about 4,000.

#32) In California's Central Valley, 1 out of every 16 homes is in some phase of foreclosure.

#31) The Mortgage Bankers Association recently announced that more than 10 percent of all U.S. homeowners with a mortgage had missed at least one payment during the January to March time period. That was a record high and up from 9.1 percent a year ago.

#30) U.S. banks repossessed nearly 258,000 homes nationwide in the first quarter of 2010, a 35 percent jump from the first quarter of 2009.

#29) For the first time in U.S. history, banks own a greater share of residential housing net worth in the United States than all individual Americans put together.

#28) More than 24% of all homes with mortgages in the United States were underwater as of the end of 2009.

#27) U.S. commercial property values are down approximately 40 percent since 2007 and currently 18 percent of all office space in the United States is sitting vacant.

#26) Defaults on apartment building mortgages held by U.S. banks climbed to a record 4.6 percent in the first quarter of 2010. That was almost twice the level of a year earlier.

#25) In 2009, U.S. banks posted their sharpest decline in private lending since 1942.

#24) New York state has delayed paying bills totalling $2.5 billion as a short-term way of staying solvent but officials are warning that its cash crunch could soon get even worse.

#23) To make up for a projected 2010 budget shortfall of $280 million, Detroit issued $250 million of 20-year municipal notes in March. The bond issuance followed on the heels of a warning from Detroit officials that if its financial state didn't improve, it could be forced to declare bankruptcy.

#22) The National League of Cities says that municipal governments will probably come up between $56 billion and $83 billion short between now and 2012.

#21) Half a dozen cash-poor U.S. states have announced that they are delaying their tax refund checks.

#20) Two university professors recently calculated that the combined unfunded pension liability for all 50 U.S. states is 3.2 trillion dollars.

#19) According to EconomicPolicyJournal.com, 32 U.S. states have already run out of funds to make unemployment benefit payments and so the federal government has been supplying these states with funds so that they can make their payments to the unemployed.

#18) This most recession has erased 8 million private sector jobs in the United States.

#17) Paychecks from private business shrank to their smallest share of personal income in U.S. history during the first quarter of 2010.

#16) U.S. government-provided benefits (including Social Security, unemployment insurance, food stamps and other programs) rose to a record high during the first three months of 2010.

#15) 39.68 million Americans are now on food stamps, which represents a new all-time record. But things look like they are going to get even worse. The U.S. Department of Agriculture is forecasting that enrollment in the food stamp program will exceed 43 million Americans in 2011.

#14) Phoenix, Arizona features an astounding annual car theft rate of 57,000 vehicles and has become the new "Car Theft Capital of the World".

#13) U.S. law enforcement authorities claim that there are now over 1 million members of criminal gangs inside the country. These 1 million gang members are responsible for up to 80% of the crimes committed in the United States each year.

#12) The U.S. health care system was already facing a shortage of approximately 150,000 doctors in the next decade or so, but thanks to the health care "reform" bill passed by Congress, that number could swellby several hundred thousand more.

#11) According to an analysis by the Congressional Joint Committee on Taxation the health care "reform" bill will generate $409.2 billion in additional taxes on the American people by 2019.

#10) The Dow Jones Industrial Average just experienced the worst May it has seen since 1940.

#9) In 1950, the ratio of the average executive's paycheck to the average worker's paycheck was about 30 to 1. Since the year 2000, that ratio has exploded to between 300 to 500 to one.

#8) Approximately 40% of all retail spending currently comes from the 20% of American households that have the highest incomes.

#7) According to economists Thomas Piketty and Emmanuel Saez, two-thirds of income increases in the U.S. between 2002 and 2007 went to the wealthiest 1% of all Americans.

#6) The bottom 40 percent of income earners in the United States now collectively own less than 1 percent of the nation’s wealth.

#5) If you only make the minimum payment each and every time, a $6,000 credit card bill can end up costing you over $30,000 (depending on the interest rate).

#4) According to a new report based on U.S. Census Bureau data, only 26 percent of American teens between the ages of 16 and 19 had jobs in late 2009 which represents a record low since statistics began to be kept back in 1948.

U.S. Authorities Shut Down WordPress Host With 73,000 Blogs

Written by enigmax on July 16, 2010 After the U.S. Government took action against several sites connected to movie streaming recently, nerves are jangling over the possibility that this is just the beginning of a wider crackdown. Now it appears that a free blogging platform has been taken down by its hosting provider on orders from the U.S. authorities on grounds of “a history of abuse”. More than 73,000 blogs are out of action as a result.

Hot on the heels of recent threats from Vice President Joe Biden and Intellectual Property Enforcement Coordinator Victoria Espinel directed at sites offering unauthorized movies and music, last month U.S. authorities targeted several sites they claimed were connected to the streaming of infringing video material.
‘Operation In Our Sites‘ targeted several sites including TVShack.net, Movies-Links.TV, FilesPump.com, Now-Movies.com, PlanetMoviez.com, ThePirateCity.org, ZML.com, NinjaVideo.net and NinjaThis.net. In almost unprecedented action, the domain names of 7 sites were seized and indications are that others – The Pirate Bay and MegaUpload – narrowly avoided the same fate.

Fears remain, however, that this action is only the beginning, and that more sites will be targeted as the months roll on. Indeed, TorrentFreak has already received information that other sites, so far unnamed in the media, are being monitored by the authorities on copyright grounds.
Now, according to the owner of a free WordPress platform which hosts more than 73,000 blogs, his network of sites has been completely shut down on the orders of the authorities.

Blogetery.com has been with host BurstNet for 7 months but on Friday July 9th the site disappeared. The following Monday the owner received an email from BurstNet:

Due to the history of abuse and on going abuse on this ‘bn.***********’ server.
We have opted to terminate this server, effective immediately. This termination applies to: bn.affiliateplex.com
Abuse Department
BurstNET Technologies, Inc

Further correspondence received the following response:

Bn.xx*********** was terminated by request of law enforcement officials, due to material hosted on the server.
We are limited as to the details we can provide to you, but note that this was a critical matter and the only available option to us was to immediately deactivate the server.

…and a later clarification:

Please note that this was not a typical case, in which suspension and notification would be the norm. This was a critical matter brought to our attention by law enforcement officials. We had to immediately remove the server.

“We notified him [the Blogetery owner] when we terminated it [the server], and we refunded him his money to his account, because he has other servers with us If he wants the refund to his card, we can easily do that. However, it should be the least of his concerns,” A BurstNet representative later confirmed.

“Simply put: We cannot give him his data nor can we provide any other details. By stating this, most would recognize that something serious is afoot.”

Due to the fact that the authorities aren’t sharing information and BurstNet are sworn to secrecy, it is proving almost impossible to confirm the exact reason why Blogetery has been completely taken down. The owner does, however, admit to handling many copyright-related cease and desists in the past, albeit in a timely manner as the DMCA requires.

Nevertheless, a couple of quick Google searches which are likely to turn up blogs which link to copyright material appear to do just that – here, here and here. That said, on any network this large this type of activity is bound to happen. Many thousands of blogs on the same platform would have been perfectly legal.

“All of the users are without service just like when the Pirate Bay raids happened and all the people who were on the host sites were also taken down,” pointed out an annoyed Blogetery user who contacted TorrentFreak. “I have lost my personal site also and I don’t have any way to contact the owner since his contact info was on the blogetery.com site & that was the only way to contact him.”

Indeed, 73,000 blogs is a significant number to take down in one swoop, regardless of what some users of the site may or may not have been doing. Time will tell if it was indeed a copyright complaint that took down the service but the signs are certainly there. Not so long ago the conclusion that this type of action could be taken on copyright grounds would have been dismissed out of hand, but the current atmosphere seems to be changing.
